Woman, 31, claims rape while under marijuana trance; man says sex was consensual

A 31-year-old woman told police Fred Francisco Blas, Sr., 63, raped her the evening of December 8, 2020. A news release from the Guam Police Department stated Mr. Blas was arrested for criminal sexual conduct, family violence, and incest, indicating the woman may be closely related to him.


Prosecutor Christine Santos Tenorio, however, is only charging Mr. Blas with two counts of third degree criminal sexual conduct. According to her declaration of probable cause against Blas, he admitted to police that the two had sex, but said it was consensual.


Here is the description of the crime in Ms. Tenorio's declaration:


"On December 8, 2020, at approximately 10:30 p.m., the Defendant and the Victim were at a Mangilao residence when the Defendant called the Victim into his bedroom. The Defendant and the Victim smoked a marijuana cigarette together. The Defendant told the Victim he was lonely. The Victim began to feel cloudy, dizzy, and numb from the marijuana cigarette. The Defendant then pushed the Victim onto the bed and took off the Victim's clothes. The Victim attempted to tight off the Defendant, but the Victim was unable because she was numb. The Defendant then proceeded to have sexual intercourse with the Victim and ejaculated in the Victim's vagina."

According to Guam law, a person is guilty of third degree criminal sexual conduct if he penetrates another person who is, among other things, mentally incapacitated or physically helpless. The definition the law gives for 'mentally incapacitated' is: "that a person is rendered temporarily incapable of appraising or controlling his or her conduct due to the influence of a narcotic, anesthetic, or other substance administered to that person without his or her consent, or due to any other act committed upon that person without his or her consent."


Mr. Blas retired from the Guam Fire Department five years ago, and held a leadership rank, according to a GFD source of information.
